Terms and Conditions
1. Sales
1.1 The firm, company or person(s) to whom the customer details are entered overleaf are responsible for the full payment for fulfilment of this order, unless it is ratified in writing prior to acceptance of the order.
1.2 This order is only valid and accepted by ADM Diving & Technical Services Ltd when signed and dated in the acceptance box by one of its employees, owners or representatives. If ADM Diving & Technical Services Ltd cannot resolve within 14 days any reason to not accept the order, then it shall be returned to the customer as a rejected order with a reasonable written explanation.
1.3 All course fees include crew pack, qualification, certificate, emblems and gas unless otherwise agreed in writing prior to acceptance of the order. These course fees do not include kit hire, boat, transport or accommodation fees.
1.4 Discounts are at the sole discretion of ADM Diving & Technical Services Ltd and are agreed at time of order based on current advertising, publicity material and the level of previous business. Unless such discount is so agreed then the list price of the latest brochure is final and binding. All prices are in £ sterling and inclusive of VAT and the company reserves the right to change its prices without notice at any time.
1.5 ADM Diving & Technical Services Ltd Gift Vouchers which are authentic and valid maybe used as credit towards any goods, service or course offered by ADM Diving & Technical Service Ltd. These vouchers must be surrendered with the booking form or at the start of the course as appropriate. The customer may reasonably request the return of the Gift Voucher(s) once invalidated.
1.6 A minimum of three weeks notice is required to cancel or postpone a course booking or trip. If supported by a Doctor’s Certificate this may be done free for a maximum of two times in any six months. Cancellations and postponements within three weeks may loose your deposit at the discretion of ADM Diving & Technical Services Ltd.
2. Method of Payment
2.1 The firm, company or person(s) responsible for payment shall make the payment with order as either, cash, postal order, debit card, credit card or guaranteed cheque made payable to “ADM Diving & Technical Services Ltd”. All prices quoted on this website are inclusive of VAT were applicable and excludes postage and packaging.
2.2 Delay in payment shall after 30 days accrue interest at 1.5% above the Bank of England Base Rate on a weekly basis. After 60 days this shall further accrue an additional £15 late payment charge and a notice of intent issued giving the customer 21 days notice of intent to take the matter to a small claims court and all reasonable additional costs will be claimed.
2.3 Should a payment fail to clear then the customer shall be charged a £15 banking administration fee on top of the owed payment, which must be paid prior to certification if this is a course. If these are goods then these goods remain the property of ADM Diving & Technical Services Ltd until all payments on them are fully cleared.
3. VAT
3.1 VAT will be charged in accordance with UK Inland Revenue guidelines at either Zero Rate or 17.5%. All prices shown on the website are inclusive of VAT were applicable and excludes postage and packaging.
4. Course Self Study Materials
4.1 ADM Diving & Technical Services Ltd shall endeavour to provide or post these goods or materials at the time of receipt of order or within fourteen working days, subject to the correct payment being received. If this is not met then ADM Diving & Technical Services Ltd will give the customer a £25 gift voucher as a goodwill payment which shall be the total limit to its liability.
4.2 The customer agrees to put time aside to fully read and embark upon all self study necessary in preparation for any course work. All knowledge reviews and quizzes must be completed prior to embarking on the course work unless otherwise agreed in writing with ADM Diving & Technical Services Ltd. Failure to do so will either result in deferment of the course and loss of all or some of your deposit at the discretion of ADM Diving & Technical Services Ltd.
5. Practical Course Work and Trips
5.1 ADM Diving & Technical Services Ltd shall endeavour to plan and make provision for problems which may arise from time to time outside of its normal control caused by weather and other cancellations. If such circumstances arise ADM Diving & Technical Services Ltd shall attempt to make alternative arrangements which are mutually agreeable to the customer or offer a refund less deposit and costs to date on such course or trip which shall be the limit of its liability.
5.2 The customer shall be responsible to ensure all personal kit is maintained and regularly serviced according to the manufacturers’ recommendations. Any such items found unfit at the start or during the course or trip shall be prohibited from use. The customer shall then be fully responsible to make alternative arrangements or hire such replacement items. If this is not possible then the customer will have to abandon the training prior to completion and complete at a later date.
5.3 ADM Diving & Technical Services Ltd shall reserve the right in accord with training agency standards to remediate a customer’s performance as necessary during a course. Should it be necessary to cancel or defer a customers training then this will be undertaken. ADM Diving & Technical Services Ltd maintains a high regard to training being purchased and qualifications being earnt. Course duration details are minimums and the company will use reasonable endeavours to keep to them where possible, but in no circumstance shall it be liable for non-delivery, non-performance or late delivery or performance.
5.4 The customer agrees to by signing this order form to read and then agree to all necessary training agency liability releases, medical declaration and safe diving practices as necessary and appropriate to the training course(s) or trip(s). The customer also agrees to, likewise read and then agree to sign all ADM Diving & Technical Services Ltd course paperwork and that they are fit and capable of undertaking such training or trip.
5.5 Where the customer is to undertake Scuba Diving training or trip involving diving, then it is required that a clear (fit for diving) medical, which is a self declaration medical, with all questions truthfully answered No or a stamped and validated medical by a GP saying the customer is fit for diving.
5.6 When ADM Diving & Technical Services Ltd sign its course roster “Student Pre-Requisits Verification” box, this shall mean that the customer meets the Age criteria, course pre-requisit qualifications, has furnished a valid medical, has presented a valid PIC Diving Qualification card and their up to date Logbook. It is the responsibility of the customer to bring these to the course otherwise the training cannot be undertaken. ADM Diving & Technical Services Ltd shall uphold the relevant training agency general standards on course pre-requisits at all times.
5.7 The customer at all times has the responsibility for all personal possessions. ADM Diving & Technical Services Ltd cannot accept any responsibility for any customer’s personal possessions at any time or location.
5.8 Where the customer is to undertake Scuba Diver Training or a trip involving diving, then it is recommended for the customer to at least 24 hours prior to and 24 hours post each dive to avoid alcohol and high caffeine beverages. Instead it is recommended to ensure good hydration and drink at least one litre of water per day to reduce the risk of DCS.
5.9 ADM Diving & Technical Services Ltd recommends that the customer plans their travel arrangements such as to avoid any altitude above 500m either by road, rail or air at least 12 hours before any Scuba Dive and avoid the same at least 24 hours after any Scuba Dive to reduce the risk of altitude induced DCS.
6. Equipment Hire
6.1 When the customer hires any equipment from ADM Diving & Technical Services Ltd the customer agrees to, before use, to perform a pre dive safety check as set out by their qualifying training agency. The customer shall not under any circumstance attempt to repair, modify or interfere with hired equipment. Should it appear not to work properly then the hired equipment must not be used and returned immediately to ADM Diving & Technical Services Ltd.
6.2 The hired equipment shall only be used by a suitably certified and competent Scuba Diver or trainee Scuba Diver under instruction or supervision on dives which do not exceed their qualifying training agency standards.
6.3 ADM Diving & Technical Services Ltd and its employees, owners and representatives shall not be held liable or responsible in any way for injury, death or other damages resulting from the use of this hired equipment.
6.4 These hire conditions apply to any third party using this hired equipment.
7. Gas Supply
7.1 ADM Diving & Technical Services Ltd shall only supply or purchase for the customer, Diving Grade Breathing Air, Diving Grade Clean Breathing Air, Diving Grade Nitrox, Diving Grade Trimix, Diving Grade Heliox and any other Diving Grade custom gas as requested by the customer. These gases will only be supplied upon furnishing an appropriate diving qualification card.
7.2 ADM Diving & Technical Services Ltd will only fill, or have filled, Diving Grade gases into suitable diving cylinders which are in test appropriate to the requested gas.
7.3 The customer in signing this order agrees to always use Diving Grade gas on all training with ADM Diving & Technical Services Ltd and will not under any circumstance use or attempt to use any volume of gas not supplied by a reputable Scuba Diving Grade Gas filling station.
7.4 ADM Diving & Technical Services Ltd and its employees, owners and representatives shall not be held liable or responsible in any way for injury, death or other damages resulting from the use of this gas.
7.5 These gas supply conditions apply to any third party using this gas.
8. Force Majeure
8.1 Neither party shall be liable for failure to perform its obligations under the order if such failure results from circumstances which could not have been contemplated and which are beyond the party’s reasonable control.
9. General Conditions
9.1 The construction, validity and performance of this order shall be governed by the Law of England.
